STRENGTHENING LEGAL CULTURE AS HUMAN RIGHTS ENFORCEMENT ACTIVITIES IN INDONESIA WITHIN PUBLIC SERVICE ADMINISTRATION PERSPECTIVE

Abstract: The provision of regulations concerning with public service administration for examples; Law No. 32/2004 regarding the Local Governance which amended into Law No. 12 12008 regarding the Local Governance, Law NO. 37/ 2008 regarding Indonesia’s Ombudsman, Law No. 25/2009 regarding Public Service, Law No, 14 of 2008 regarding Public Information Transparency, substantially already in accordance with the guidance of human rights norms and the Constitution of Indonesia (UI-JD 1945). The public service administration emphasized on public interest, participatory, the equal rights and treatment, balance of rights and responsibilities accountable, facility and special treatment for special group, time accuracy, efficiency, effectiveness, easiness and reach ability is only on paper well structured but worst on application domain. The result of investigation from Governance and Decentralization Survey (GDS) shown that public service administration still indicate with broad service discrimination, low level of satisfaction from the public as recipient of service, and the tendency to transformed public service into commodity. Unfortunately, the activities for improving quality of public service administration tend to repair only the law structure and law substantial instead of improving the culture of law aspect. The legal culture is serve as entire value and system of society, and public law awareness is the motor of justice which determine how the law implementation within public domain. Its impossible in implementing and enforcing [aw of public service administration without knowledge and understanding support regarding the entitled law awareness from the public. The law enforcement is the certain thing in order to improving quality of public service administration. Every public service administration provider (government Institution, corporate, independent agency serving for public interest, and law agency regarding public service) has duty on of public service administration law enforcement. The activities supporting of public service administration are: (1) Developing information system regarding public service including storage, management and delivery information mechanism from service provider and vice versa, (2) Increasing publication, communication and socialization of public service administration, (3) developing educational and training of public service law and (4) Socializing value and examples of public service administration.
