Abstract: Direct elections theoritically provide a very broad space for the community to participate actively in determining public officials in their respective regions. However, based on empirical reality of the implementation of direct elections has been running since June of 2005 until December of 2008, there are some fundamental problems that need to be studied further lelih. Considering the Implementation of Regional Head elections directly in some areas is still marked by political conflict, mass anarchism, and is still going various forms of fraud – from the political money (money politics), not neutral election organizers and local bureaucrats and mobilization to win a particular candidate pair. So that these issues be counterproductive to the struggle for democratic values are to be upheld. However, despite the various shortcomings of the implementation of the Regional Head Election is directly, the big question is no less important than anything else that would be answered in this article is a follow-up of how such violations, wether the couple can cancel local chief elected candidate. Then, what about the resolution of election disputes in the Constitutional Court.
