KEBEBASAN BERTINDAK (DISKRESI) DALAM KONSEP OTONOMI DAERAH

Abstract: Discretion is the authority of the officials of public administration which is used in making decision to overcome such problems by paying attention or considering the boundary of valid law, good of government principles, and the norms that is developed among people. According to the mandate of Law No.22/1999 which has been reviewed by Law No.32/2004 states that Local Government based on their duty and function is given of such freedom to accelerate the realization of people walfare through the solution or innovation of of local policy that is still stand with in the provision which has been valid above it. This is then which has become the basic of implementation of policy guide of local government.
